1. About CircleCal

CircleCal (“CircleCal”, “we”, “us”) provides scheduling and booking tools for coaches and businesses (the “Service”). These Terms govern your access to and use of the Service.

2. Accounts and Eligibility

  • You must be at least 18 years old to use CircleCal.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • If you invite staff or managers, you remain responsible for their access and actions within your organization.

3. Acceptable Use

You agree not to misuse the Service. For example, you will not:

  • Use the Service for unlawful, harmful, or fraudulent purposes.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Interfere with the Service (e.g., scanning, probing, overloading, scraping, or introducing malware).
  • Reverse engineer or attempt to extract source code except to the extent allowed by law.

4. Bookings, Availability, and Business Policies

  • Businesses control their own availability, services, and booking rules in CircleCal.
  • Your customers/clients may interact with booking pages that you publish.
  • Refunds: Businesses may define their own refund/cancellation terms per service. Payments processed through CircleCal may also be subject to platform rules and payment processor requirements.

5. Payments and Billing (Stripe)

If you purchase a paid plan, CircleCal uses Stripe as the primary payment processor for business owners. By paying through the Service, you agree that:

  • Your payment information is processed by Stripe; CircleCal does not store your full card number.
  • Subscription fees (if applicable) may renew automatically until you cancel, unless otherwise stated at checkout.
  • Taxes may apply depending on your location and the nature of the services provided.

6. Your Content and Data

You retain ownership of content you submit to the Service (such as business details, availability, services, and booking data). You grant CircleCal a limited license to host, store, process, and display your content only as necessary to operate and improve the Service.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to those practices.

8. Availability and Changes

We may update or modify the Service over time, including adding or removing features. The Service may be unavailable occasionally for maintenance or other reasons.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if required to comply with law. We may also restrict access to protect the Service, users, or the public.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, CircleCal disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, CircleCal will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. CircleCal’s total liability for claims relating to the Service is limited to the amount you paid to CircleCal for the Service in the 12 months before the event giving rise to the claim (or $100 if you have not paid anything), unless a different limit is required by law.

12. Governing Law

These Terms are governed by the laws of the State of California, excluding its conflict of law principles, unless a different governing law is required by applicable law.
